By accessing or using audit.domains ("Service"), operated by audit.domains ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Service Description

audit.domains provides domain name valuation and appraisal services using deterministic algorithmic analysis: the same domain always produces the same appraisal. Our Service includes:

  • Automated domain name valuations computed from structured, documented valuation factors
  • Market analysis and comparables using our curated, price-verified real sales database
  • Published methodology and accuracy reporting
  • Account-based domain saving and history tracking

Our Domain Valuation Engine provides sales-calibrated valuations by analyzing recorded historical sales, linguistic patterns, and brandability metrics against our curated real-sales corpus.

3. IMPORTANT DISCLAIMERS

3.1 Valuations Are Estimates Only

ALL VALUATIONS PROVIDED BY audit.domains ARE ESTIMATES ONLY. They are not guarantees, promises, or commitments of actual market value. Domain valuations are algorithmic predictions based on available data and market analysis. Actual sale prices may vary significantly based on buyer interest, market conditions, negotiation, timing, and numerous other factors beyond our control or prediction capability.

3.2 Not Financial or Investment Advice

audit.domains does NOT provide financial advice, investment advice, or professional consulting services. Our valuations should not be used as the sole basis for any financial decision. Always conduct your own research and consult with qualified professionals before making investment decisions.

3.3 No Guarantee of Accuracy

While we strive for accuracy, we make no warranties or guarantees regarding the accuracy, completeness, or reliability of our valuations. The domain market is volatile and unpredictable. Our algorithms use historical data and market trends, which may not accurately predict future outcomes.

3.4 Sales Database Accuracy

Our sales database contains a curated set of price-verified domain sales from publicly available sources including verified marketplaces and public sales data. While we curate this data carefully, we cannot guarantee complete accuracy of historical sales figures, as they are sourced from third-party reports and public disclosures. The database is continuously updated and refined to improve accuracy, but actual market values may vary.

4. User Accounts

When you create an account with us, you must provide accurate, complete, and current information. You are responsible for:

  • Safeguarding your password and account security
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access
  • Ensuring your contact information remains current

5. Pricing and Billing

5.1 Pricing Plans

audit.domains offers the following plans. Paid plans may be billed monthly or annually; annual billing is charged for ten months (two months free).

  • Free: 3 appraisals/month, no credit card required
  • Plus: 50 appraisals/mo — $39/month billed monthly, or $390/year billed annually ($33/month effective)
  • Pro: 250 appraisals/mo — $129/month billed monthly, or $1,290/year billed annually ($108/month effective)
  • Max: 1,500 appraisals/mo — $399/month billed monthly, or $3,990/year billed annually ($333/month effective)

All tiers have hard monthly caps; no plan offers unlimited appraisals. Appraisal credits reset at the start of each billing cycle.

5.2 Payment Terms

By subscribing to a plan, you agree to pay the applicable monthly fee. Payments are processed securely through Square, our payment processor. All fees are in USD unless otherwise stated. Appraisal credits reset each billing cycle.

5.3 Subscription Plans

All paid plans are available as monthly or annual subscriptions. Appraisal credits are added to your account at the start of each billing cycle and reset each cycle. You may upgrade, downgrade, or cancel your subscription at any time from your account settings.

5.4 Refund Policy

In accordance with Square's refund policies, audit.domains offers a 14-day money-back guarantee for all subscription plan purchases. You have the right to request a refund within 14 days of your initial subscription purchase.

This refund policy is an effective measure to avoid chargebacks and the fees that these incur, as required by Square's terms. To request a refund, please contact us at [email protected] with your account email and purchase date.

6. Acceptable Use Policy

You agree NOT to:

  • Use the Service for any illegal purpose or in violation of any laws
  • Attempt to gain unauthorized access to our systems or networks
  • Scrape, crawl, or systematically extract data from the Service
  • Reverse engineer, decompile, or disassemble our algorithms or software
  • Resell, redistribute, or share your account access
  • Upload malicious code, viruses, or harmful software
  • Harass, abuse, or harm other users
  • Use the Service to send spam or unsolicited communications
  • Misrepresent your identity or affiliation
  • Exceed or attempt to circumvent your plan's monthly appraisal credit limits, including through the API

7. Intellectual Property Rights

audit.domains and its original content, features, and functionality are owned by audit.domains and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Our algorithms, valuation methodologies, and proprietary data are confidential trade secrets. Unauthorized use or disclosure is strictly prohibited.

8. User Content and Data

You retain ownership of domain names you input and data you provide. By using our Service, you grant us a limited license to process this data solely to provide our services to you.

We may use anonymized, aggregated data for improving our algorithms and services.

9. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, audit.domains SHALL NOT BE LIABLE FOR:

  • ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES
  • ANY DAMAGES RESULTING FROM RELIANCE ON OUR VALUATIONS
  • ANY DAMAGES FROM INVESTMENT DECISIONS BASED ON OUR SERVICE
  • ANY INACCURACIES IN VALUATIONS OR DATA

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS, OR $100, WHICHEVER IS GREATER.

10. Warranty Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR VIRUS-FREE.

11. Indemnification

You agree to indemnify and hold harmless audit.domains, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use or misuse of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any investment decisions you make based on our valuations

12. Data Privacy and GDPR Compliance

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your data. By using our Service, you consent to our data practices as described in the Privacy Policy.

13. Service Modifications and Termination

We reserve the right to:

  • Modify or discontinue the Service at any time without notice
  • Change pricing with 30 days' notice to existing customers
  • Suspend or terminate accounts for Terms violations
  • Update these Terms (we'll notify you of material changes)

14. Dispute Resolution

14.1 Informal Resolution

Before filing a claim, you agree to contact us at [email protected] to attempt to resolve the dispute informally.

14.2 Arbitration Agreement

Any disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association's Commercial Arbitration Rules. You waive your right to a jury trial.

14.3 Class Action Waiver

You agree to resolve disputes individually and waive the right to participate in class actions, class arbitrations, or representative actions.

15. Governing Law and Jurisdiction

These Terms shall be governed by the laws of Delaware, United States, without regard to conflict of law provisions. Any legal action must be brought in the state or federal courts located in Delaware.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and audit.domains regarding the Service.
